EU law has recognized that there needs to be protection of individual member states, as under the current system they represent the members of each nation and integrity. This is recognized through the principles of; direct effect of directives, acts and regulations[6]; the principle of proportionality; equality between member states; and the sovereignty of individual states. Therefore there must be an adherence to these laws in the nation states, to be in contravention of these laws indicates a breach of the key precepts of the EU and the national law is subject to EU law. This has caused much concern whether this means that in fact member states are not sovereign states[7]. The Court of Justice’s role includes the measure to ensure that the more powerful nations do not overpower the smaller member states. Therefore instead of eroding sovereignty of individual member states it ensures that the sovereignty of smaller member states is not engulfed by the larger member states. Hence it is a balancing of power within the EU in order to maintain the national integrity and sovereignty of smaller states, which has the possible effect of eroding the sovereignty of larger nations. EU does include safety measures in the principle of direct effect, where third parties are not bound by the laws and decisions of the ECJ, i.e. decisions of enforcement are only directly applicable to the government and domestic laws[8] and indirectly applicable to government organisations[9].Therefore in relation to the EU being a plural political and legal governing body the main limitation to the power of EU law is that it only directly applies to Member-States or organizations that are monitored by the government of the Member-States; therefore stressing the lack of democracy for the individual citizen within the EU.
